《漢律》:“齊人予(與)妻婢姦曰姘。”《玉篇》、《集韻》引都作“齊人”,此當是指齊方言。嶽麓(五)說的是另一回事,指齋中的特殊情況。漢律,與妻婢通姦都有罪。《史記•高祖功臣侯者年表》:“元鼎二年,侯頗坐尚公主,與父御婢姦罪自殺,國除。”又《夏侯嬰傳》:“子侯頗尚平陽公主。立十九歲,元鼎二年,坐與父御婢姦罪,自殺,國除。”《漢書•高五王傳》:“五鳳中,青州刺史奏終古使所愛奴與八子及諸御婢姦,終古或參與被席。”又《淮南衡山濟北王傳》:“孝坐與王御婢姦……皆棄市。”又“太子知王常欲廢己而立孝,乃謂王曰:‘孝與王御者姦,無采,與奴姦。”《漢紀》卷25:“乃令人誣告商與父侍婢姦。”

秦代要求男女關係是“防隔内外,禁止淫泆,男女絜誠”(《會稽刻石》)。不過蕭先生指出的這些例證,都是“御婢”,根據史學界現在的看法“御婢”地位較為特殊,雖為奴婢,但實質上是夫妻關係,因此作為兒子姦淫父親的“御婢”相當於姦淫後母,屬於十惡不赦的“禽獸行”,故而採取極刑。回過頭來看說文《漢律》:“齊人予妻婢姦曰姘。”,一般將“齊人”當齊地,或是“齊民”,懷疑大家這裏都想多了“齊人”就是“同人”,齊訓為同,指同他人的妻子、奴婢姦淫叫“姘”。換言之不是與已婚女性或有主奴關係的奴婢的姦淫不稱為“姘”,法律界定非常明確,好像今天還是這個意思。
